Pat Chapman presented the Department's recommendation that the Commission delegate rulemaking authority to the Director to amend WAC 220-110-204, Use of Class II Mineral Prospecting Equipment; and WAC 220-110-205, Use of Class III Mineral Prospecting Equipment. Numerical errors have been found in these two rules requiring screening of pump intakes when withdrawing water from fish-bearing waters during mineral prospecting. Sections (6) of these rules need to be amended to change "one-thousandths" to "one-hundredths" to make them enforceable and protective for fish.

Commissioner Tuck moved, seconded by Commissioner Pelly, to delegate rulemaking authority to the Director to amend WAC 220-110-204, Use of Class II Mineral Prospecting Equipment; and WAC 220-110-205, Use of Class III Mineral Prospecting Equipment. The motion carried unanimously.

The Commission and Department staff discussed legislative issues.
