CONFERENCE CALL January 29, 1999 - 4:00 PM Olympia, Washington ATTENDANCE: Commission Department Kelly White, Chair Larry Peck, Deputy Director Russ Cahill, Vice Chairman Pat Chapman Dean Lydig Tim Smith, Legislative Liaison Pat McMullen Lisa Pelly Public Will Roehl None Bob Tuck Commission Staff Debbie Nelson Pat Chapman presented the Department's recommendation that the Commission delegate rulemaking authority to the Director to amend WAC 220-110-204, Use of Class II Mineral Prospecting Equipment; and WAC 220-110-205, Use of Class III Mineral Prospecting Equipment. Numerical errors have been found in these two rules requiring screening of pump intakes when withdrawing water from fish-bearing waters during mineral prospecting. Sections (6) of these rules need to be amended to change "one-thousandths" to "one-hundredths" to make them enforceable and protective for fish. Commissioner Tuck moved, seconded by Commissioner Pelly, to delegate rulemaking authority to the Director to amend WAC 220-110-204, Use of Class II Mineral Prospecting Equipment; and WAC 220-110-205, Use of Class III Mineral Prospecting Equipment. The motion carried unanimously.
