Chair Ozment called the conference call to order at 9:05 a.m.

EXECUTIVE SESSION:
The Commission immediately went into Executive Session pursuant to RCW 42.30.110 to discuss the compensation of a public employee or employees. The Executive Session was closed to the public. No action was taken during the Executive Session.

Chair Ozment called the conference call back to order at 9:24 a.m.

Commissioner Shiosaki moved, seconded by Commissioner Roehl, to make the Director's position pay raise retroactive to April 1, 2005. The motion carried unanimously.

SALE OF WILD SHELLFISH RULES -- ACTION:
Lisa Veneroso briefed the Commission on the status of stakeholder meetings regarding proposed WAC rules that had been continued from the May 5, 2005, Commission conference call. These WAC rules would establish a trial commercial fishery license and trial fishery permit for aquatic farmers that harvest wild embedded shellfish on private property.

- Amendments to WAC 220-52-018, Clams--Gear;
- Amendments to WAC 220-52-020 Clams--Commercial harvest;
- WAC 220-88D-010, Emerging commercial fishery--Commercial wild clams, mussels, and oyster shellfish fishery on nonstate tidelands and bedlands;
- WAC 220-88D-020, Designation of the commercial wild clams, mussels, and oyster harvest on nonstate lands as an emerging commercial fishery;
- WAC 220-88D-030, Eligibility to participate in the nonstate lands commercial wild clams, mussels, and oyster shellfish fishery; and
- WAC 220-88D-040, Nonstate lands commercial wild clams, mussels, and oysters--Application requirements--Survey and notification requirements--incidental take prohibited.

Based on the most recent meeting between stakeholders and Department staff, the Commission agreed with staff's recommendation that action on the adoption of these rules be continued to a future date.

The shellfish growers have requested a written statement of the Department's legal authority to adopt this emerging commercial fishery rule.

CRAB POT BUOY IDENTIFICATION -- BRIEFING
Phil Anderson briefed the Commission on implementing crab pot identification and the potential need for rule changes in the future.

GENERAL DISCUSSION:
Commissioners and the Deputy Director Peck discussed recent activities and items of interest.
