FRIDAY, JUNE 4:

Vice Chair Ozment called the workshop to order at 9:05 a.m.

COMMISSIONERS' DISCUSSION:
Commissioners discussed recent activities and items of general interest and provided status reports on Commission committees.

DIRECTOR'S REPORT:
Director Koenings reviewed significant Department issues and activities.

PRIORITIES OF GOVERNMENT:
Jim Cahill, Office of Financial Management, provided information to the Commission regarding the Governor's "Priorities of Government" budget development process, which began in 2002.

BUDGET UPDATE:
Deputy Director Peck provided a status report on the Department's current biennial budget.

OPEN PUBLIC INPUT:
Two individuals provided oral testimony on issues of concern during this portion of the workshop.

HATCHERY REFORM - BRIEFING:
Paul Seidel and Jim Scott presented information to the Commission regarding the recently published report, "Hatchery Reform: Principles and Recommendations of the Hatchery Scientific Review Group".

DOGFISH SHARK STATUS - BRIEFING:
At the request of the Commission, Greg Bargmann along with Dr. Vincent Gallucci, Cindy Tribuzio and Ian Taylor (University of Washington) briefed the Commission on the status of dogfish shark.

AMENDMENTS TO COMMERCIAL HERRING RULES - BRIEFING:
Greg Bargmann and Mike Cenci briefed the Commission on proposed rule amendments to accurately track the amount of herring placed in a net pen and ensure that all herring in the net pen are accounted for on fish tickets. The Commission will consider final adoption of rule amendments at its August 6-7, 2004, Commission meeting in Lynnwood.

COMMERCIAL AND RECREATIONAL FISHERIES IN HOOD CANAL - RULE BRIEFING:
Morris Barker and Duane Fagergren (Puget Sound Action Team) briefed the Commission on proposed amendments to protect stocks/species in Hood Canal that cannot be adequately protected through the use of emergency rules. The Commission will consider final adoption of rule amendments at its August 6-7, 2004, Commission meeting in Lynnwood.

INTEGRATION OF HYDRAULICS AND FOREST PRACTICES IN NON-FISH BEARING STREAMS - RULE ADOPTION:
John Mankowski, Jane Banyard, and David Price presented WAC 220-110-035, Miscellaneous hydraulic projects - Permit requirements and exemptions, which would integrate hydraulics and forest practices permits for non-fish bearing streams.

Five individuals provided oral testimony on the rule proposals during the workshop.

Because of concerns, which included no MOA has been developed, a monitoring plan is needed, and non-fish-bearing streams are not well enough surveyed, Commissioner Pelly moved, seconded by Commissioner Hunter, to postpone a decision until the November 5-6, 2004, Commission workshop. The motion to postpone a decision carried unanimously.

ADOPTION OF THE MANAGEMENT POLICY FOR PACIFIC HALIBUT FISHERIES IN WASHINGTON:
Phil Anderson and Michele Robinson, presented proposed changes to Commission Policy C-3601, Management Policy for Pacific Halibut, which would (a) ensure consistency between the International Pacific Halibut Commission, Pacific Fishery Management Council, and the Department; (b) clarify the Department's management approach relative to halibut fisheries; and (c) describe the function of the Department's ad hoc Halibut Advisory Group.

One individual provided oral testimony on the policy during the workshop.

Commissioner Shiosaki moved, seconded by Commissioner Van Gytenbeek, to adopt the changes to Policy C-3601, Management Policy for Pacific Halibut, as proposed and amended by staff. The motion carried unanimously.

PROPOSED LAND TRANSACTIONS:
Dan Budd presented four land transactions for the Commission's consideration and approval.

Commissioner Pelly moved, seconded by Commissioner Shiosaki, to approve the following land transactions:

- Acquisition of the 3.91-acre Diking District #3 property in Pacific County for $5,500;

- Grant a .16-acre additional easement at Ebey Island in Snohomish County to Olympic Pipeline Company for $1,000;

- Sale of the 9.6-acre Wenas-Fink 2 property in Yakima County to Lyle and Louise Schneider for $37,756; and

- Sale of the 20-acre Rochester-Livington, Pheasant Habitat parcel in Thurston County to Trevor Westlund and Carl Teitge for $288,800.

The motion to approve the land transactions carried unanimously.

AMENDMENTS TO COMMERCIAL SEA URCHIN AND SEA CUCUMBER RULES - BRIEFING:
Morris Barker briefed the Commission on proposed amendments to clarify fishing boundaries. The Commission will consider final adoption of rule amendments at its August 6-7, 2004, Commission meeting in Lynnwood.

AMENDMENTS TO SHELLFISH CLASSIFICATION RULES - BRIEFING:
Morris Barker briefed the Commission on proposed amendments to clarify classified shellfish species and decrease confusion. The Commission will consider final adoption of rule amendments at its August 6-7, 2004, Commission meeting in Lynnwood.

OPEN PUBLIC INPUT:
No oral testimony on issues of concern was received during this portion of the workshop.

EXECUTIVE SESSION:
The Commission met in Executive Session to discuss with legal counsel representing the Department pending and/or potential litigation to which the Department is or is likely to become a party. The public was not allowed to attend the Executive Session.

Vice Chair recessed the workshop at 4:55 p.m.

SATURDAY, JUNE 5:

Vice Chair Ozment called the workshop back to order at 9:30 a.m.

OPEN PUBLIC INPUT:
Six individuals provided oral testimony on issues of concern during this portion of the workshop.

WIND POWER GUIDELINES - BRIEFING:
Greg Hueckel briefed the Commission on the Department's Wind Power Guidelines. These guidelines were developed by Department staff with proponents from the wind power industry, represented by the Renewable Northwest Project and biological consultants from WEST who have worked with wind power projects throughout the United States.

PROPOSED WDFW/DNR LAND EXCHANGE - BRIEFING:
Mark Quinn and Jeff Tayer and George Shelton (Washington Department of Natural Resources) briefed the Commission on the status of the proposed Washington Department of Fish and Wildlife/Washington Department of Natural Resources' land exchange, which would consolidate ownerships, change wildlife area boundaries, and meet budget reductions.

COUGAR MANAGEMENT AND IMPLEMENTATION OF SSB 6118 - BRIEFING:
Sean Carrell, Donny Martorello, and Rich Beausoleil briefed the Commission on cougar management and the implementation of SSB 6118.

SUMMARY OF COMMISSION REQUESTS TO THE DEPARTMENT:
The Commission reviewed and updated the Summary of Commission Requests to the Department.

MISCELLANEOUS AND WORKSHOP DEBRIEF:
The Commission discussed items that arose immediately before or during the workshop but after the preliminary agenda was published.

OPEN PUBLIC INPUT:
One individual provided oral testimony on issues of concern during this portion of the workshop.
