DELEGATION OF AUTHORITY TO THE DIRECTOR FOR NORTH OF FALCON REGULATIONS

Larry Peck presented the Department's request for the Commission to delegate the authority to the Director to adopt permanent and emergency regulations resulting from the agreements made during the annual North of Falcon process, consistent with the Commission's policies. Previous North of Falcon policies were year-specific: in 1997, the language was "...1997 North of Falcon..."; in 1998, the language was "...1998 North of Falcon..."; etc.

Commissioner Pelly moved, seconded by Commissioner Roehl, to delegate authority to the Director to make harvest agreements with Northwest Treaty Tribes and other governmental agencies, and to adopt permanent and emergency regulations resulting from the agreements made during the annual North of Falcon process. The motion carried unanimously.

The Commission suggested that the annual North of Falcon Policy include wording to indicate that the Commission has permanently delegated this authority to the Director.

DELEGATION OF AUTHORITY TO THE DIRECTOR FOR THE COASTAL DUNGENESS CRAB POLICY

Phil Anderson presented the Department's request for the Commission to delegate the authority to the Director to adopt permanent and emergency regulations concerning the Coastal Dungeness Crab Even Flow Harvest Management Plan. At the August meeting, the Commission delegated the authority to the Director to implement the Even Flow plan for the 1999-2000 season. The Attorney General's Office, after reviewing the Small Business Economic Impact Statement, suggested that it needed to be rewritten. The earliest the modified proposed rule would go into effect is January 18. Because the coastal crab fishery is scheduled to open December 1, the Department plans to file an emergency rule that would be in effect on that date. The motion language would provide the Department the flexibility of implementing the preferred alternative (three-tiered system for a pot limit) over a longer period of time.

Commissioner Van Gytenbeek moved, seconded by Commissioner Roehl, to delegate authority to the Director to adopt permanent and emergency regulations to implement the preferred alternative of the Coastal Dungeness Crab Even Flow Harvest Management Plan. The motion carried unanimously.
