FRIDAY, OCTOBER 3:

Chair Roehl called the workshop to order at 8:30 a.m.

COMMISSIONERS' DISCUSSION:
Commissioners discussed recent activities and items of general interest and provided status reports on Commission committees.

DIRECTOR'S REPORT:
Director Koenings reviewed significant Department issues and activities.

BUDGET UPDATE:
Jim Lux provided a status report on the Department's current biennial budget.

OPEN PUBLIC INPUT:
Five individuals provided oral testimony on issues of concern during this portion of the workshop.

Representative Mike Cooper (21st District) and the Commission had an informal discussion on trapping issues.

PERMANENT ANNUAL LICENSE RAFFLE - BRIEFING:
Frank Hawley briefed the Commission on the development and implementation of the permanent annual license raffle.

HUNTER EDUCATION BUDGET UPDATE:
At the request of the Commission, Mik Mikitik briefed the Commission on the status of funds devoted to the Hunter Education Program.

ATLANTIC SALMON SURVEYS - BRIEFING:
John Kerwin and Pam Meacham briefed the Commission on the status of work conducted through a two-year grant from the Pacific States Marine Fisheries Commission to conduct surveys for juvenile Atlantic salmon in selected Washington state streams, which began in July 2003.

COLUMBIA RIVER LIMITED PARTICIPATION SALMON NET FISHERIES - BRIEFING:
Cindy LeFleur and Tim Flint briefed the Commission on a regulation that would allow for limited participation fisheries to occur in the Columbia River. The Commission will consider taking action on this item at its December 5-6, 2003, meeting in Port Townsend.

COLUMBIA RIVER SPRING CHINOOK MANAGEMENT - BRIEFING:
Bill Tweit and Cindy LeFleur briefed the Commission on a request for a new Columbia River spring chinook fishery policy. The Commission will consider taking action on this item at its December 5-6, 2003, meeting in Port Townsend.

COLUMBIA RIVER STURGEON RESEARCH UPDATE - BRIEFING:
Bill Tweit, Brad James, and Dr. Molly Webb (Research Scientist from Oregon State University) briefed the Commission on the current research being conducted on Columbia River white sturgeon.

COASTAL DUNGENESS CRAB FISHERY - BRIEFING:
Phil Anderson and Heather Reed briefed the Commission on the status of the coastal Dungeness crab fishery, including negotiations with Oregon and California regarding differential starting dates and domoic acid events.

EXPERIMENTAL FISHERY FOR PACIFIC SARDINE - BRIEFING:
Michele Robinson and Brian Culver briefed the Commission on the results of the Department's limited-entry regime, the federal allocation strategy, and the 2003 sardine fishery.

COASTAL GROUNDFISH FISHERY UPDATE - BRIEFING:
Phil Anderson and Michele Robinson briefed the Commission on groundfish items that are being addressed in the Pacific Fishery Management Council forum.

COMMERCIAL GROUNDFISH CASE INVESTIGATION - BRIEFING:
Mike Cenci, Kevin Harrington, and Mack Peterson briefed the Commission on a case investigation involving the illegal commercial take of groundfish.

OPEN PUBLIC INPUT:
One individual provide oral testimony on issues of concern during this portion of the workshop.

Chair Roehl recessed the workshop at 5:20 p.m.

SATURDAY, OCTOBER 4:

Chair Roehl called the meeting back to order at 9:00 a.m.

OPEN PUBLIC INPUT:
No oral testimony on issues of concern was received during this portion of the workshop.

PROPOSED LAND TRANSACTIONS:
Dan Budd presented numerous land transactions for Commission consideration of approval.

Commissioner Pelly moved, seconded by Commissioner Cahill, to approve the following land transactions:

- Acquisition of the 34.06-acre Garrison property in Jefferson County for $185,000;
- Sale of the Coast Seafoods property in Jefferson County to the Port of Port Townsend for $287,000 with the Department retaining timber rights;
- Renewal of the University of Washington's license on the L.T. Murray Wildlife Area for thirty years;
- Sale of timber in the Colockum Wildlife Area in Kittitas County;
- Sale of timber in the Sinlahekin Wildlife Area in Okanogan County;
- Sale of timber in the L.T. Murray Wildlife Area in Kittitas County'
- Easement exchange with with Delores Sargent in Mason County; and
- Concession agreement in the Oak Creek Wildlife Area in Yakima.

The motion to approve the land transactions carried unanimously.

DEPARTMENT GRAZING PERMITS RELATIONSHIP TO SENSITIVE SPECIES - BRIEFING:
At the request of the Commission, Paul Dahmer and Mark Quinn briefed the Commission on the overlap and/or relationship between grazing lands, state priority habitats, and specific areas in which listed species have been identified.

SPECIES OF CONCERN - BRIEFING:
At the request of the Commission, Harriet Allen briefed the Commission on the general status of and recovery plans for species now listed in Washington State.

SPECIAL TRAPPING PERMITS - BRIEFING:
Sean Carrell, Donny Martorello, and Bruce Bjork briefed the Commission and discussed options available for issuing trapping permits within the provisions of Initiative 713. The Department will bring to the Commission at its November 21-22, 2003, workshop in Richland recommended changes to the permitting process. Chair Roehl will provide a report to Governor Locke prior to December 1, 2003.

PRIVATE LANDS WILDLIFE MANAGEMENT AREA PROGRAM UPDATE:
At the request of the Commission, George Tsukamoto briefed the Commission on the status of the Private Lands Wildlife Management Area Program. The Commission will consider revisions to the PLWMA policy at its November 21-22, 2003, workshop in Richland. The Commission will consider taking action on adopting PLWMA seasons at its December 5-6, 2003, meeting in Port Townsend.

OILED WILDLIFE PROPOSED RULES - BRIEFING:
Eric Larsen briefed the Commission on the status of developing new rules to address oiled wildlife rescue and rehabilitation operations. Depending on the progress of stakeholder meetings to develop new rules, the Commission may consider taking action on adopting such rules at its December 5-6, 2003, meeting in Port Townsend.

APPROVAL OF MINUTES:
Commissioner Reynolds moved, seconded by Commissioner Van Gytenbeek, to approve the minutes of the following:

- April 11-12, 2003, Commission meeting;
- June 6-7, 2003, Commission workshop;
- August 7, 2003, Commission conference call; and
- August 21, 2003, Work Session with the Department of Ecology.

The motion to approve the minutes carried unanimously.
(Commissioner Hunter was absent during discussion and vote on the motion.)

SUMMARY OF COMMISSION REQUESTS TO THE DEPARTMENT:
The Commission reviewed the Summary of Commission Requests and considered new requests.

Commissioner Reynolds moved, seconded by Commissioner Van Gytenbeek, to request the Department compile and provide an expanded version of the State listed species sheet. The spreadsheet would show: (1) the date each species was listed as a state-listed species; (2) whether or not a recovery plan is in place; (3) date of the initiation of the recovery plan; (4) anticipated or actual date of completion of the recovery plan; (5) the annual budget, if any, for each species; (6) the source(s) of the budget; and (7) budget requests, if any. The motion to request Department action carried unanimously. (Commissioner Hunter was absent during discussion and vote on the motion.)

Commissioner Van Gytenbeek moved, seconded by Commissioner Cahill, to request the Department provide at the January 2004 workshop a briefing on the chemicals being used by the Seattle Yacht Club and private dock owners on Lake Washington. Briefing would include a description of the problem and alternatives that could be used. The motion to request Department action carried unanimously. (Commissioner Hunter was absent during discussion and vote on the motion.)

Commissioner Van Gytenbeek moved, seconded by Commissioner Cahill, to request the Department provide at the January 2004 workshop a briefing on the Puget Sound Action Team (what does it do, its authority, and how does it interface with the Department). The motion to request Department action carried unanimously. (Commissioner Hunter was absent during discussion and vote on the motion.)

2004 COMMISSION MEETING AND WORKSHOP DATES:
After discussion, the Commission selected the following dates and locations for its 2004 Commission meetings and workshops:

- January 16-17, 2004, workshop, Olympia;
- February 6-7, 2004, meeting, Olympia;
- March 12-13, 2004, workshop, Olympia;
- April 9-10, 2004, meeting, Spokane;
- June 4-5, 2004, workshop, Olympia;
- August 6-7, 2004, meeting, Snohomish County;
- October 1-2, 2004, workshop, Olympia;
- November 5-6, 2004, workshop, Clarkston; and
- December 3-4, 2004, meeting; Long Beach or Ocean Shores.

COMMISSION OFFICE POSITION:
Due to budget concerns, Commissioner Cahill moved, seconded by Commissioner Hunter, to remove the request for an additional Commission position from the Supplemental Budget. The motion carried unanimously.

COMMERCIAL FISHING LICENSE SUSPENSION REVIEW COMMITTEE:
The Commission reviewed and considered a list of candidates for appointment to its Commercial Fishing License Suspension Review Committee, which was established by House Bill 1057. The following were appointed:

- Motion by Pelly, second by Cahill, to approve the following land transactions:
